These Terms of Use (“Terms”) govern your access to and use of Tailboard, including the website located at https://tailboard.net and any related services, content, and features (collectively, the “Site”). The Site is owned and operated by Tailboard, LLC (“Tailboard,” “we,” “us,” or “our”).

By creating an account, logging in, or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

Tailboard is intended for adults. You must be at least 18 years old to create an account or use the Site. By using Tailboard, you represent and warrant that you meet this requirement and that you have the authority to enter into these Terms.

2. Changes to the Site and Terms

We may update the Site and these Terms from time to time. If we make material changes, we may notify you by posting an update on the Site or by emailing the address associated with your account.

Your continued use of Tailboard after changes take effect means you accept the updated Terms.

3. License to Use the Site

Subject to these Terms, Tailboard grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use.

4. Restrictions

You agree that you will not:

  • Sell, rent, lease, or commercially exploit the Site or access to it

  • Copy, reproduce, distribute, publicly display, or create derivative works from the Site except as allowed through normal use of the features

  • Reverse engineer, decompile, or attempt to extract source code or underlying ideas of the Site

  • Access the Site to build a competing product or service

  • Use automated tools (bots, scrapers, scripts) to access or interact with the Site in a way that disrupts service or bypasses limitations

  • Attempt unauthorized access to accounts, servers, or systems

  • Interfere with the security, integrity, or performance of the Site

We may suspend or terminate access for violations of these restrictions.

5. Accounts, Security, and Invitations

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activity that occurs under your account

  • Keeping your account information accurate and up to date

Tailboard may use invite codes or other access controls. You agree not to sell invite codes, automate signups, or attempt to bypass access controls.

6. Tailboard Features and Community Use

Tailboard includes features such as The Line, Dispatch, Debriefs, Groups, Pages, Profiles, and Merits. These features exist to support professional discussion and knowledge-sharing within the fire service community.

You understand and agree:

  • Content you post may be visible to other members depending on settings and where it is posted

  • Tailboard does not guarantee that any post, answer, or user-submitted content is accurate, complete, or appropriate for your situation

  • You are responsible for how you apply information you read on the Site

Tailboard is not a substitute for department policy, training standards, medical advice, legal advice, or professional judgment.

7. User Content

7.1 What “User Content” Means

“User Content” includes anything you submit, post, upload, or publish through the Site (including text, images, comments, messages, questions, Debriefs, and other materials).

You are solely responsible for your User Content and for the consequences of posting it.

7.2 Rights You Grant Tailboard

To operate the Site, you grant Tailboard a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting and display), distribute, and display your User Content only as needed to provide and improve the Site and its features.

This includes, for example, displaying your content in a Group, showing it in The Line, or allowing others to view it based on your settings.

7.3 Removal and Moderation

Tailboard may remove, restrict, or modify User Content at any time if we believe it violates these Terms, creates risk, or harms the community. We are not obligated to store or maintain User Content and may delete it without notice.

8. Acceptable Use Policy

You agree not to post, upload, transmit, or distribute content that:

  • Violates any law or regulation

  • Infringes intellectual property, privacy, or other rights

  • Is harassing, threatening, abusive, defamatory, or intentionally misleading

  • Is obscene, pornographic, or patently offensive

  • Promotes violence, hatred, or discrimination against any group or individual

  • Contains malware, harmful code, or attempts to compromise systems

  • Collects or solicits personal information from other users without consent

  • Spams, floods, or disrupts the community

  • Impersonates any person or misrepresents affiliation

We may investigate violations and take action including content removal, account restriction, account termination, and referrals to law enforcement when appropriate.

9. Merits

Merits are a recognition tool designed to highlight meaningful contributions. Tailboard may adjust, revoke, or restrict Merit-related functionality to maintain integrity of the system, address abuse, or improve features.

Merits do not represent compensation, employment endorsement, certification, or professional credential.

10. Feedback

If you submit suggestions, ideas, or feedback, you agree that Tailboard may use it without restriction or compensation, and you grant Tailboard the right to incorporate it into the Site.

11. Third-Party Links

The Site may contain links to third-party websites or services. Tailboard does not control these third-party sites and is not responsible for their content, policies, or practices. Your use of third-party sites is at your own risk.

12. Termination

We may suspend or terminate your account or access to the Site at any time, with or without notice, if we believe:

  • You violated these Terms

  • Your use creates risk to the community, the Site, or other users

  • Your account is involved in abuse, fraud, or security issues

Upon termination, you lose access to your account and the Site. Content you posted may remain visible where it has been shared with others, though we may remove or anonymize content where appropriate.

13. Disclaimers

The Site is provided “as is” and “as available.” Tailboard disclaims all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, secure, error-free, or free from harmful code.

14. Limitation of Liability

To the maximum extent permitted by law, Tailboard and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site.

To the maximum extent permitted by law, Tailboard’s total liability for any claim will not exceed $50 USD.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Tailboard and its owners, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from:

  • Your use of the Site

  • Your User Content

  • Your violation of these Terms

  • Your violation of any law or third-party rights

16. Copyright and IP Complaints (DMCA)

Tailboard respects intellectual property rights and may remove content alleged to infringe copyright and terminate repeat infringers.

If you believe content on the Site infringes your copyright, provide a notice including:

  • Your signature (physical or electronic)

  • Identification of the copyrighted work

  • Identification of the infringing material and where it appears

  • Contact information (address, phone, email)

  • A statement of good faith belief that use is not authorized

  • A statement under penalty of perjury that the information is accurate and you are the rights holder or authorized agent

17. Dispute Resolution and Arbitration Agreement

Please read this section carefully. It affects your legal rights.

17.1 Informal Resolution

Before filing a claim, you agree to contact Tailboard and attempt to resolve the dispute informally.

Include your name, account email, a description of the dispute, and the relief requested.

If we cannot resolve the dispute within 30 days, either party may proceed as described below.

17.2 Binding Arbitration

Except for claims that qualify for small claims court or claims involving intellectual property rights, disputes arising out of or relating to these Terms or the Site will be resolved by binding arbitration on an individual basis.

Arbitration will be administered by the American Arbitration Association (AAA) under its consumer arbitration rules, unless the parties agree on a different provider.

17.3 Class Action Waiver

You and Tailboard agree to resolve disputes only on an individual basis. You waive any right to participate in a class, collective, or representative proceeding.

17.4 Small Claims

Either party may bring an eligible claim in small claims court instead of arbitration.

18. Governing Law and Venue

These Terms are governed by the laws of Minnesota without regard to conflict of law principles.

If a dispute is found not subject to arbitration, you agree that it will be brought in the state or federal courts located in Hennepin County, Minnesota and you consent to personal jurisdiction there.

19. Electronic Communications

By using the Site, you consent to receive communications from Tailboard electronically, including email and in-site notices, and agree that electronic communications satisfy legal notice requirements.

20. Entire Agreement

These Terms, together with the Privacy Policy and any posted guidelines, constitute the entire agreement between you and Tailboard regarding the Site.

If any provision is found unenforceable, the remaining provisions will remain in effect.

21. Privacy Policy

Your use of Tailboard is also subject to our Privacy Policy.
